Disclaimer

General

The information published on www.haitirecycling.net is provided by HAITI RECYCLING S.A. for general informational purposes only. While we make reasonable efforts to keep the Website accurate and up to date, we make no representation or warranty, express or implied, regarding the completeness, accuracy, reliability, suitability, or availability of any information, product description, image, or material on the Website.

Product Specifications and Technical Data

Product categories, specifications, grades, and processing capabilities described on the Website are indicative only. Actual specifications for any given lot, shipment, or production run are determined by the order confirmation, sales contract, certificate of analysis, or other technical documentation issued by Haiti Recycling for that specific transaction. Buyers and prospective buyers must rely on the documentation issued for their specific order, not on Website content.

Photographs and images on the Website are illustrative. They may not reflect the precise color, dimension, or condition of materials supplied under any particular contract.

Environmental, Sustainability, and Circularity Statements

Statements on the Website regarding environmental impact, sustainability, recycling outcomes, recycled content, employment generation, and contribution to circular-economy objectives reflect Haiti Recycling’s general operational philosophy and the company’s good-faith understanding at the time of publication. They are general descriptive statements, not technical claims, and they are not intended to be relied upon as substantiated environmental performance claims for the purposes of regulatory regimes governing environmental marketing, including (without limitation) the European Union’s framework on green claims, the United Kingdom Competition and Markets Authority’s Green Claims Code, and the United States Federal Trade Commission’s Guides for the Use of Environmental Marketing Claims (the “Green Guides”).

They are not a guarantee of any specific environmental, social, or economic outcome and should not be treated as a certification, audit, life-cycle assessment, or technical opinion. Where a customer requires substantiated environmental information for its own regulatory, contractual, or marketing purposes, that information is provided in writing through the contractual documentation governing the relevant transaction.

Without limiting the foregoing, Haiti Recycling does not guarantee that any specific material collected, processed, or supplied will be recycled, reused, or repurposed in any particular manner, or that any particular volume or proportion of material will be diverted from landfill or incineration. Downstream processing, transportation, and end-use are subject to commercial, technical, and regulatory factors and may involve third-party facilities beyond Haiti Recycling’s control.

Cross-Border Shipments and Regulatory Compliance

Haiti Recycling exports recovered materials and engineered resins to multiple jurisdictions, including the United States, the European Union, and the United Kingdom. Customers are responsible for satisfying themselves that the importation, classification, and use of any product purchased from Haiti Recycling complies with the laws of the destination country, including:

  • the international framework implementing the Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and their Disposal;
  • in the European Union, Regulation (EU) 2024/1157 on shipments of waste, the REACH Regulation, and product-safety legislation;
  • in the United Kingdom, the equivalent waste-shipment, chemical-substance, and product-safety regimes;
  • in the United States, the Toxic Substances Control Act (TSCA), the Resource Conservation and Recovery Act (RCRA) and applicable Environmental Protection Agency rules concerning hazardous and non-hazardous solid waste, and U.S. Customs and Border Protection import requirements;
  • the customs, environmental, and product-safety laws of any other destination country.

Nothing on the Website should be read as a legal opinion that any product is admissible into any particular jurisdiction. Specific compliance representations are made only in the contractual documentation governing the relevant transaction.

Third-Party Processors, Transporters, and Downstream Facilities

Haiti Recycling may engage third-party processors, transporters, brokers, downstream facilities, or end-users in the collection, sorting, processing, transportation, export, or further treatment of materials. Haiti Recycling does not control, and is not responsible for, the operations, regulatory compliance, environmental performance, labor practices, or commercial conduct of such third parties beyond the scope of the contractual obligations expressly assumed by Haiti Recycling toward its direct counterparty in writing.

Where a counterparty requires assurances regarding the chain of custody of specific materials, those assurances are addressed in the contractual documentation governing the relevant transaction and not through the Website.

Industry Memberships and Third-Party Logos

References on the Website to industry associations — including the Bureau of International Recycling (BIR) and the Recycled Materials Association (ReMA, formerly ISRI) — and the display of associated logos reflect Haiti Recycling’s membership status at the time of publication. They do not constitute an endorsement, certification, or representation by those associations regarding any specific product, transaction, or business practice of Haiti Recycling.

Forward-Looking Statements

The Website may contain statements about Haiti Recycling’s strategy, capacity, growth, or future operations. These statements reflect current intentions and are subject to risks, uncertainties, and changes in circumstances. They are not guarantees of future performance and should not be relied upon as such.

Website Availability and Security

Haiti Recycling does not guarantee that the Website will be available at all times, free from errors or interruptions, or free from security vulnerabilities, viruses, or other harmful code. Access to the Website may be suspended, restricted, or terminated at any time, with or without notice, for maintenance, security, or any other reason. To the fullest extent permitted by applicable law, Haiti Recycling shall not be liable for any loss or damage arising from any such unavailability, error, interruption, or security incident.

No Liability for Use of Website Information

To the fullest extent permitted by applicable law, Haiti Recycling shall not be liable for any loss or damage — including indirect or consequential loss, loss of profits, loss of business, or loss of data — arising from reliance on information published on the Website, from temporary unavailability of the Website, or from any error or omission in Website content. Nothing in this clause limits any liability that cannot be excluded under applicable law.
